INTRODUCTION AND BACKGROUND

This book will be written in the form the author uses in writing briefs, which is somewhat unusual, as he almost, but not always, represents himself, thus the pro se, which means for himself, and means you may, or may not, be a lawyer.

The following is a sanitized  version of publications the Appellant placed on his www.wrathofkahn.org  Note that just this first issue will appear on here Future issues will be on wrathofkhan.org... The sanitization was performed because Kahn attempts to use humor (satire) on the Wrath website to hopefully, lessen the fatigue of readers and to make it difficult for those identified as “knaves,”  “villains” or the “bad guys” to file non-frivolous defamation suits.  Let me start my UN believable story... Honest if I didn’t have all the official court records, IRS papers, and especially my local Social Security Office statements, BULL..

The owners of HD/TV, full digitalized TV have honest engineers and managers,and if you ask them why the clicking on

the Phone and the Fax dies during storms they tell you the truth. It is normal with Digital Signals. 

As announced by Defendant Clear Channel’s main talk station ..Rush, Shawn, etc., WIOD 610 kHz in Miami/Ft. Lauderdale, that with the start of the Hurricane season, Remember that portable TV will not work, so you cannot depend on it the way that you did last year. HDTV is Dead… Denying the rich and especially the poor who cannot afford Cable TV… Free TV…

This is due to a well accepted and tested weakness of all digital systems, the signal must be stronger than the noise or the signal will be totally suppressed, lost. (A pun may be the lowest form of humor, but here it a real aid in stressing a scientific fact.  “All” means, every digital system that is truly “all” digital meaning no envelope, no AM component, and a bandwidth from dc to at least twice the highest frequency component of the digital wave shapes...” Any one of you theoreticians...Got an idea?)  Of course, many techniques have been researched such as coding, diversity, time frequency and space for over 75 years, ¾ a century, by brilliant engineers all over the world led by Bell Labs, when Bell Labs, was part of AT&T, along with Western Electric prior to its antitrust breakup by Jack Goeken, a really, unique guy that I will tell you about later.  But it is a losing battle because of multipath fading, reflections from aircraft and even birds...even if you had the SPECTRUM... 

Did any POLITICIAN read the last paragraph??? If you did, you now KNOW that you have been subject to a HUGE FRAUD, maybe the biggest in the history of man … $1,000,000,000. A good way to show how big this fraud is: The entire United States DEBT is $11.6 Trillion!  

Makes Teapot Dome look like a teaspoon.  THERE IS NO SPECTRUM TO AUCTION OFF... You have to STEAL spectrum just to make room for HD/TV/Radio!!!   

BUT Clear Channel and their “in house” engineers better not even try to tell the TRUTH, If they do it may lose their jobs.

Better follow the party line and propagandize the press and even the FCC Commissioners,but not the top FCC

engineers, they know the truth,but they cannot overrule politically appointed commissioners.

What is iBiquity’s NEW PARTY LINE? ... They defend their failure to accomplish their promise to the FCC that if they were

granted a monopoly for digitalizing AM & FM Radio they would complete their work in the summer of 2009.

This Opinion and Belief is based upon what iBiquity and its supporters have whispered to my potential customers.

AND indeed, even misled the SDNY into Ruling in the Antitrust Case that iBiquity was the de facto Standard as if that

allowed them to BOYCOTT Kahn technology.

However they are now stalling, after all the dummy banks still have some millions to throw away. UBC, “International Credit Bank,” of Geneva. That major Swiss banks were used by post WWII Nazi Germans, is well documented and certainly discovery following FRCP rules will provide evidence that will insure that “Due Process” manifestly missing here in this case.

But of course the “faceless” Judge Naomi Reice Buchwald, “faceless” because Her Honor ORDERED her law clerk not to let me, who I will often refer to with great affection as Loveable Leonard herein, (the Villains have other not as affectionate, names)... to sit in the back of her Courtroom, procedure has followed for over 50 years of courtroom experience, to get comfortable with individual Judges and their clerks run their Courts.  

At least the Plaintiff fire fighter in Ricci was permitted to see the Judge and the file a Motion for Summary Judgment with some form of Due Process.. We just have to wait for one of the 100’s of junior and senior lawyers to decide that they are not going to risk the disgrace of disbarment.

In the mean time they suckered, hoodwinked, huge banks into financing iBiquity technology that has never passed, nor can it pass FCC tests, to the tune of hundreds of Billions of Dollars... and they have used hundreds of Millions of Dollars to “convince” the FCC Commissioners (See WSJ photo of former FCC Chairman “in bed” with 2 lobbyists)... in a scheme to force Americans to replace their 800 Million radios... A ridiculous pot of gold” plan that J.P. Morgan, Chase, and a group of major investment banks bankrolled, after putative “due diligence.”  

By the way I filed such a statement...affirmed it to Federal Judges, under the penalty of perjury...  No thanks...I had enough bad food in the Army (also some great food) and I don’t like the peers.

Want to hear the biggest joke, the NAB, registered lobbyist, have fooled the FCC and the Congress with, indeed our entire Government, Administrative.

I know I already told that joke.. But since, a little obese guy Fritz was made head of NAB, for the sole reason that a Senator Joke from LO, that killed the impeachment of the Second Worst President, he even beats out Carter... because Republicans should be so uptight about sex.. He Senator LO wasn’t an intellectual Giant... Clinton, hatred of women,,, was not the problem... If your non-engineering boss is swallowing the HOAX, find a WOR in your town and let him listen with his own two ears or better with his wife’s ears, to a radio car, or even better. Digital 1 kHz fine tune radio.  Draw a spectrum display, he will enjoy explaining it to other broadcasters proving he knows science.

Dear Sir:                                         

The reason for this urgent letter is that the pressure on my right eye measured earlier today was 17... much too high as I have Glaucoma and, unless immediately corrected I will be blind in at least one eye.  The surgeon that operated on my eyes is the best in NYC and his Office will be faxing a letter setting up an operating room for the surgery. Also my cardiologist, who has treated me for decades, also a senior Professor, wants to take further tests as to why my blood pressure that was controlled for years suddenly jumped up and he will send me a letter.

Now since Mayor Bloomberg is so adamant that he will not call off his Human Resources enforcement group, Exh. 1, even though they acted pursuant to the Florida  H&H group, which investigated the false complaint that I was senile for issuing 2 checks, which they knew were good, but claimed were bad... And Florida found “No services recommended” Final Report..Exh. 2.  Clearly, this document speaks for itself.

The next Document, Exh. 3, not only speaks for itself, but PROVES that the FCC acted erroneously and that Mayor Bloomberg has to

continue  to attack me as his fortune is tied up in Bloomberg Communications, that cannot operate without FCC Licenses AND boycotted my inventions that it had used successfully until the full blown NYC boycott started... Thus, my strategy of suing Bloomberg Communications, was too effective, just like my suing his friend Tisch, for terminating the life of my wife of 40 years, brought not only NYU Tisch Hospital, with its RICO program for harvesting and selling to the highest bidder, very effective older peoples’ vital organs...Also brought in NYU Law school...where many clerks attended and even are on the faculty.

Said third document that shouts for itself, Exh. 3 is section 112 of the 2007 Revision of the Telecommunications Act of 1934 that established the FCC, directly named, me Leonard Kahn and states unequivocally that the FCC did not allow me to PETITION MY Government...the clearest admission I have been able to find, of a serious Constitutional violation, much clearer than Ricci ....

Now, I know it is not considered to be effective brief writing to argue more than 3 major points, but since I now have irrefutable PROOF, Wachovia converted my Social Security Checks, a Federal Crime, see Exh. 4.

Please note the Social Security Administration says on the first page of this signed three page letter, that it can be used for any purpose I wish... Therefore, the Honorable District Court, under FRCP 34 and 37 had to issue the Discovery Order, even though Wachovia is, and was, a major political force in Florida.     

In conclusion, I need an urgent ORDER to save my vision, and maybe from a stroke, or heart attack, from your Honorable Court, that was confused by desperate clerks who spread the lie that I was senile, ENJOINING the City of New York from its stated plan to take me into custody, Exh. 1.

Since no would ever believe what they did to me have to abbreviate You would never believe what

they did to me as “U-NevrWoodBelvIt” or even at times as "U-NW-Bit"

First of all let me start just with the business side of the story because if you Dear Reader, especially if you are a lawyer...if you are a JUDGE that has a nodding... (no disrespect...not that type of nodding off to sleep) – acquaintance with the Bill of Rights... Non-lawyer readers it is worth the twenty minutes of your time.. These are the first ten Amendments to the Constitution passed by congress on sept 25^th 1789 and 3/4 of the states dec 15, 1791   note the 13^th amend was only passed in 1865 freeing the slaves and it took great bloodshed as Ben Franklin the greatest of the greatest innovators in the history of man and ladies too.

Anyway if you, especially after reading this gothic tale, are still going to act PRO SE , you, silly sole better understand every word and nuance And then if you stick with Federal Courts where you really should be able excerciseee your RIGHTS start reading the Rules of Civil Procedure... Even this pro se kid stays away from Criminal Cases because you can expect fun with the Fifth Amendment.

FIRST OF ALL LET ME SHOW HOW I ACT LIKE A LAWYER, I WILL CHEAT LIKE A LAWYER

If you think I am going to write page after page when I can get away with plagiary... I will quote from my own documents...For example this morning I spoke to the smartest Clerk of a Federal District Court and I told her I wanted to be certain that the “LOCAL RULES” permitted me to as a pro se party sign my discovery demands... Lawyers “U-NevrWoodBelvIt” in every recent case I have filed in the SDNY, in good old NYC I have been blockedd with every single document... Really want proof.... Here we go....

COUNTS

1. Conversion                                      4. Violation of Constitutional Rights

2. Extortion, Fraud & RICO                5. Conversion of Social Security Checks 

3. Civil Rights Violation                      6. Violation of FDIC Rules & Regulations

JURISDICTION

This action is of a civil nature involving, for each of the six counts, exclusive of interest and costs, a sum of excess of Ten Thousand Dollars and no/100 (10,000.00 Dollars) and therefore federal jurisdiction exists under 28 U.S.C. 1337.  (Kahn Communications, (KCI), is not a necessary party, even though it has suffered substantial damages.)   Furthermore, since a Racketeer Influenced and Racketeering Organization count is alleged, the Plaintiff may select any Federal District Court in the United States to file and litigate this suit. (18 U.S.C. 1965)

(The Original Case Was Filed as 08 CV 61676 and was dismissed, without prejudice.)

1. As a direct result of unnamed John Doe Defendant Oppenheimer’s making a frivolous and what appears to be a fraudulent Complaint declaring that the Plaintiff is incompetent, the Plaintiff fled Florida in fear of losing a citizen’s most vital Constitutional Right his Right to Liberty... Indeed in the Preamble of the Constitution a basic reason for the founding of our Country was declared to “Secure the Blessings of Liberty.”     

2. As a further direct result of Oppenheimer’s Complaint that, because Kahn had ALLEGEDLY, passed 2 small bad checks, a false allegation...(Please see the Affidavit, Exh. 1, of the prestigious Long Island, New York banker, Mr. Patrick Demery, showing Kahn’s checks were good, as have been Kahn’s checks in 50 years of owning and running small businesses.)

3. But the Corporation Counsel for Defendant City of New York and its Defendant Mayor, owner of Station WBBR, AM 1130 kHz,  argued the NYC Health & Human Services Administration Agency was acting within their authority, therefore they were authorized to chase Kahn and interfere with Kahn’s vital work at his R&D Lab on Long Island, on the iSAFE^tm System for Homeland Security to avoid another 9/11/01 Communications internet Disaster. The work done at the Lab also allowed Kahn to pay payroll, rent and his living expenses. (At this time KCI has temporally ceased operations and was even threatened by his landlord of 10 years with dispossession, when just a few years ago Kahn’s fortune exceeded $16 million.  Mayor Bloomberg, also refused to act on Kahn’s direct plea to overrule the politically explosive frivolous, sophomoric, argument that this Honorable Court lacked Jurisdiction, citing the 11^th Amendment.  However, the Plaintiff suggests his right to Life & Liberty under the Constitution, and Bill of Rights, and the Magna Carta were not overruled by the Eleventh Amendment. (If the 11^th Amendment was so powerful, why are there literally tens of thousands of suits successfully filed against police departments all over the country?)    

4) The Plaintiff wishes to simplify this suit in one respect and dismiss the case against the State of Florida because it acted in good faith under its laws and promptly and effectively concluded its study of the frivolous & outrageous complaint by Defendant Oppenheimer.  On the other hand, Kahn is now in a position to name four new John Does as actual Defendants: Harris Corp., (Harris according to iBiquity’s website is the main manufacturer of iBiquity radio equipment AND provides the FCC certificates of compliance which is impossible according to the Plaintiff’s analysis and measurements...  Siga Communications of Texas, and, CUM, Inc., of Florida, and most importantly, Mayor Bloomberg who joined in the boycott by all of the major NYC stations, the basis of the Antitrust suit now being readied for appeal to the United States Supreme Court. 

5) Clearly, the City of New York’s vicious, inhumane behavior in bullying not only defamed Kahn, an over 80 year old man living alone, where he and his late wife resided for over a quarter of a century, along with neighbors including lawyers and even Judges and the NYC home of the head of the CIA where the Health and Human Services Administration it threatened a powerful, 220 pound Concierge at Kahn’s Murray Hill Co-Op, and this unacceptable behavior continued after Kahn provided some six “To Whom It May Concern” proof of competency statements and cannot be ignored by the Plaintiff, who along with all his direct male members and his wife’s family fought for this Country. (See Exhibit 2)

6) And Defendant Bloomberg refused to call off the chase like the Plaintiff was a wild animal fleeing to his research laboratory on Long Island.  So once again Kahn had to run, this time back to Florida, where he (wrongly) expected to be safe.  The Plaintiff, absent any discovery, and not having the educational training required to evaluate the mental health of individuals, such as the woman, Ms. Carol Hall, who appears to have mental problems, (maybe sadism), but Kahn will arrange for her examination prior to trial, to determine if she should be named as an actual Defendant, and not remain in her present status as a Jane Doe. (This will also be true of the large “gentleman” who physically threatened the Concierge at Kahn’s NYC Home all of which took place after Florida issued its “No Services Recommended” final Report!

7) When Oppenheimer, (and Wachovia), claimed Kahn had insufficient funds he actually, had over a quarter of a million dollars in just one of his accounts. (Please see the Affidavit, Exh. 1, of  Long Island, NY banker, Mr. Patrick Demery, showing not only Wachovia converted Kahn’s Social Security checks but it lost two checks totaling over $90,000.00 and overcharged Kahn over $125,000.00 on another transaction, SunTrust may have helped Wachovia violate FDIC Rules. 

Prior to the to SunTrust lost Kahn’s money  enjoyed a top reputation as a prompt payer all valid debts and John Doe Wachovia not only stole his money but directly violated Kahn’s instruction by halting the automatic payment of Kahn’s mortgage payments, thus given the conspiracy and crime of conversion of Kahn’s Social Security Checks, Kahn believes he can convince a jury of  a RICO charge and maybe even a possible charge of traitorous activities.  (As of today June 23, 2009, Wachovia still has not complied with Kahn’s demand for a copy of his full bank statement, and their Attorney, seemingly unable to control his client, FAXed Kahn an 80 page document, said document contained  only two (2) pages that had anything to do with the converted (purloined) Social Security Checks.)

BACKGROUND, WHO IS THE PLAINTIFF?

8) With the exception of Siga, all of the Defendants are well known. While Kahn may be known to R&D type Communications engineers and some Patent lawyers, he, most assuredly will be unknown to most readers of this Complaint.  Thus, for background, the Plaintiff is a former Adjunct (Full) Professor of Engineering and an inventor with over 80 US patents and over 200 hundred foreign patents, including inventions like one key to the Airfone Public telephone system on airlines, the only system that worked on 9/11/01.  Kahn was also the first to publish an analysis of Ratio Square Diversity, now used by NASA to send robots into deep space and explore the edge of the universe.  Kahn also successfully invested license fees he received from the Ratio Squarer, AM Stereo, his EER System, used to manufacture all superpower analog radio transmitters, and the Symmetra-Peak, used by a 1000 AM/FM stations, including VOA, BBC, Vatican  ABC, CBS, & NBC.  And as an U.S. Patent Agent, in 2007 won one Supreme Court issue, of major importance to all inventors, re “obviousness,” the main reason most patents are found invalid.  The PTO’s argument that Kahn ridiculed, was the source for Justice Scalia’s famous Illogical Gobbledygook remark... But it is a real stretch that Oppenheimer, et al feared pro se Kahn, even if they knew of the Kahn vs. GM, “Customer Suit” Exception.

WHY DID THE DEFENDANT BANKS TAKE SUCH RISKS FOR $500,000?

9. Frankly, the Plaintiff could not believe prestigious banks such as Wachovia, Oppenheimer, SunTrust, TD Ameritrade would engage in what may be criminal behavior over $17,000 Social Security Checks... And frankly the Plaintiff, until most recently could not understand why SunTrust would risk their license and make it possible to be named a Racketeer Organization to cover-up fraud or just negligence on the part of its officers and employees.... On the other hand, Kahn is fully aware of Boss Tweed type NYC politics and the hubris of petty bureaucrats such as Jane Doe Ms. Hall and 80 year old Vets and innocent loyal employees of the Carlton Regency... And Mayor Bloomberg ignore the pajama parties of the NYC Mafia Boss, after Mayor Rudy Giuilliani took off the streets... But they are so courageous when bullying senior citizens... And Bloomberg and his Police Commissioner single handedly OVERLOADED NYC cellular system to enforce city traffic with a system that any serious engineer would scoff at.... The Plaintiff will, if he is ever permitted to return to NYC and get treatment of the World’s best Doctors like Pecker, Liebmann and Harrison... Ft. Lauderdale is a close second and in a few cases the best...Kahn will talk to his fellow NYers about how their Mayor made more money with his innocent “Day Traders.”

10. The real reason Kahn was so attacked has nothing to do with his age or that he lives alone, but rather the Plaintiff controls patents and trade secrets that are the only competition to iBiquity Digital which are, believe or not under settled qui tam law, far more valuable than troubled banks, such as Wachovia and SunTrust, as iBiquity has convinced hoodwinked huge banks iBiquity technology that has never passed FCC tests  worth hundreds of Billions of Dollars... and they have used hundreds of Millions of Dollars to “convince” the FCC Commissioners (See WSJ photo of former FCC Chairman “in bed” with 2 lobbyists)... in a scheme to force Americans to replace their 800 Million radios... A ridiculous “pot of gold” plan that J.P.Morgan Chase, and a group of major investment banks bankrolled, after putative “due diligence.”

11. Since the Defendant have blocked every single attempt to do any discovery in NYC’s SDNY

and yet granted a Motion to Dismiss in violation of Due Process.  And since Kahn of his Constitutional Rights that is evidenced by Paragraph 112 of the 2007 Telecommunications Act of 1934 establishing the FCC, denying him the Right to Petition the Government (Count 2) and alleges that C.U.M., almost amusingly, (if it was happening to some one else), violated Federal (and Florida) Laws regarding age and religious discrimination it may useful to quote a well respected expert on applications of the

Federal Rules of Civil Procedures, Richard A. Givens:

“For purposes of a Rule 12(c) motion, all controverted allegations in the pleadings of the moving party are treated as false, while all properly pleaded material facts in the opposing party’s pleading are treated as true.” Page 548, Manual of Federal Practice, 5^th Edition, Richard A. Givens, Lexis Law Publishing 1998

12. Banks and credit organizations; SunTrust, American Express and unnamed conspirators

Regarding American Express, it induced Kahn to turn in his “Gold Card” which he used for over 30 years to make personal and business purchases, and who always paid on time, for a new “Platinum Card” with longer payment periods and team membership where, not only did he get significant savings on overnight shipments, but broadcasters could get longer periods to pay for Kahn Communications’ products... But after the bait was swallowed, Kahn got notice; American Express, said “oops,” it was having financial problems and not only was Platinum no good but Kahn could no longer use his trusty Gold Card.  Unfortunately, for American Express, Kahn will prove at trial Kahn informed its top management how pleased Kahn was with their plan and how important Platinum was to Homeland Security.. Thus, it cannot plead ignorance of the damage it has done to America.    

Sue him as CEO of Bloomberg WBBR, who was part of the NYC stations that boycotted... Simple but most effective...Now let me get back to plagiary.     

Specifically, Who are the Defendants?

13. Broadcasters; Bloomberg, Siga... Bloomberg has received sufficient discussion, supra, but Siga Broadcasting requires at least a summary of its part in participating in the alleged RICO count.  KCI installed a Cam-D system at Siga station in Texas. The controversy may have initiated when Kahn refused to sign a false opinion that Siga’s old POWER-side unit was hit by lightning during a specific two week period when Siga had, (most conveniently), special insurance.  But then Siga, with the advise of Clear Channel major stations in Houston and with the complicity of iBiquity’s main supplier of iBiquity equipment, Harris, see following section, refused to follow Kahn’s installation orders.  Finally, Siga insisted that Kahn order his recommended installation engineer (and Siga’s own station engineer) work on the circuits coupled to the antenna towers during lightning.  Thus, Siga actually has argued that a few day delay would be more important than the engineers’ lives.  The Plaintiff seeks a Jury Trial to test Siga’s legal theory.

14. iBiquity, FCC Commissioners, and Harris provide a perfect example of the working of a

noer Exception to the Anitrust laws and Kahn’s Right to Petition the Government.  Actually, if one combines the activities of Bloomberg, with the NYC SDNY name Defendants and the main John and Jane Does, it would be, the Plaintiff would argue, difficult to find a stronger per se violation of Sherman 1 and 2 and NY antitrust laws.  Note Harris filed FCC forms that stations met FCC rules.

15. C.U.M., Inc., AT&T: Clearly Kahn’s Counterclaim contains some serious alleged damages, that far exceed Mr. Tighe’s  demand for attorney’s fees.  As the Court will recall, Kahn stated that he did not, and does not have enough funds to continue the conditional lease with its “Jew Tax” and more importantly, C.U.M.’s refusal to permit him to use a dish antenna to communicate with HOMELAND SECURITY GOVERNMENT Florida & Federal AGENCIES, as AT&T, still involved with Bell Labs through Lucent which is one of the five Defendants now facing appeal in the United States Supreme Court, refused to provide normal service to any Kahn radio transmitter in Oakland Park .  Thus, the spacious upper floor office was useless for Kahn’s stated plan to demonstrate his iSAFE^tm invention, and indeed, for any broadcast studio service, as C.U.M. and its attorneys were informed, therefore, C.U.M. unilaterally terminated the contract.  Since, key shouting conversations with the “Nazi” or one of his lawyers, can be confirmed by witnesses, a jury may well equate C.U.M’s actions as disloyalty to Florida and, indeed, to the United States.  Thus, manifestly, federal issues will control the case and the case should not be removed to the

Honorable Broward County Court. (The Plaintiff, recognizing he will at least endanger part of his attorney/client privilege just a few minutes ago while writing a third draft of this Complaint received a call from a well known attorney who has for some 20 years practiced almost exclusively at the Broward Court... and he refused to take the case as “it never happened, you are a liar.”  (Therefore, I will tone down the following, even though I can and will testify under oath for depositions and the requested trial.)    

 Furthermore, if Mr. Tighe now changes his attitude re discovery, I will withdraw the new 6^th Defense i.e., “Knowingly and willingly Interference with State and Federal Homeland Security, that some might believe are acts of disloyalty.”  Actually, in my personal opinion, this question may be best investigated by the Justice Department, not in this civil action.

CONCLUSION AND PRAYER

a) Issue an injunction enjoining Defendant Bloomberg who manifestly acted ex parte, motivated by political reasons used his power as Mayor to support the NYC Human Resources Administration and even after he personally was notified that Florida had found Kahn was not in need of any services, Mayor Bloomberg permitted NYC to continue its unfounded attack on the Plaintiff and refused to end Kahn’s ordeal so he can return to his birth-place and be treated by his NYC doctors;

b) Permit Kahn to conduct Discovery to defend himself against brand new Motions to Dismiss and support requests for sanctions for prior frivolous motions;

c) Schedule a trial as soon as it is convenient for this Honorable Court;

d) Relief is sought individually and severally and that joint and several judgments be entered in Plaintiff’s favor against each of the Defendants; and

e) In addition the Plaintiff prays that this Honorable Court grants such other and further relief as the Court deems just.

Dear Reader, Please note the importance of my understanding why Mr. Bloomberg, was taking

such a huge risk of hounding me and clearly violating my rights.. (Thus, I sued him as CEO of Bloomberg communications... Not bad for the old pro se Kid), It had nothing to do with his mayoral duties... just the opposite and if I died or disappeared, broadcasters, many decade long friends would destroy Mayor Bloomberg, politically..So why take such a risk?

And he, and his attorneys, of course should have known of RKO General vs. The FCC... that forces the FCC to take FCC licenses from Sherman violators and sell (auction them off) by the U.S. Treasury and, I guess, Albany to reduce government debts... All in the Public Interest...

TODAY, August 19, 2009, JUST THIS MORNING THE SECOND CIRCUIT DENIED MY PLEA RE: The reason for this urgent letter is that the pressure on my right eye measured earlier today was 17... much too high as I have Glaucoma and, unless immediately corrected will be blind in at least one eye. The surgeon that operated  on my eyes is the best in NYC and his Office will be faxing a letter setting up an operating room for the surgery. Also, my cardiologist, who has treated me for decades, also a senior Professor, wants to take further tests...

Anyway, using the U.S. District Court in Salt Lake for the RICO charge will work as they will not listen to Mayor Bloomberg and NYU’s Tisch.  Let us see what I can do to Mayor Bloomberg when he tries to buy another election.

Much safer to steal the SS Checks, especially if the crook Is a FDIC Bank ... The BIGGEST joke is if a Bank steals NEVER go to the JOKERS at the COC In Atlanta...call me...

a) FRCP 34, FRCP 37, the RICO Act, Ricci and not to ignore the United States Constitution, the Bill of Rights, individually and severally would negate Wachovia Bank, NA’s Motion Dated July 31, 2009 and the pro se Plaintiff requests new and more severe sanctions, as the instant Motion is even more frivolous than any, and all, previous Attorney Foudy’s Frivolous, and insulting work products. Late yesterday, August 4, 2009, after doing technical work on the iSAFE^tm and Cam-D^tm Systems, I received Judge Gold’s Order, which I respectfully request him to reconsider as it may act as a death sentence for Plaintiff Kahn as I should have my cardiac expert Doctor in NYC see me and also my eye surgeon also in NYC reduce pressure in at least my right eye to save me from blindness in that eye. All of this is well known to Mr. Foudy and the politically powerful Ruden, McClosky firm and further proves how important is an immediate response to Wachovia’s “Motion to Quash” and demonstrates the Irresponsible lawyering of Mr. Foudy, Esq. and Ruden… All of these lawyers should note that a senior official in the Homeland Security pointed out that alt persons invoked in this matter should be aware of the 1996 ECONOMIC ESPIONAGE ACT 18 U.S.C. 1831-9.... 15 year prison terms and up to $10,000,000.00 fines as Mr. Foudy and the Ruden McClosky firm know, the ultimate result of their actions will result in their taking control of my homes in NYC and here In Fort Lauderdale where ultra secret documents and even circuit board prototypes are stored and that the enemies of our Country could (would)  use to block my iSAFE and Cam-D Systems that various Agencies of the United States have Informed me is the only system that can avoid another, and much worse, 9/11/01 disaster In New York City and even maybe more importantly Washington, where all the agencies of our government are housed.(details disclosed on my web site, wrathofkahn.org, also note Justice Thomas and  other Security Official visitors)

U.S. Patent Agent that since, as alleged supra, the real purpose is to further DELAY, and deny me my, and any Citizens Most basic Right, the RIGHT TO LIBERTY, additional, and most serious sanctions, should be awarded, and the attorney, who authored these Motions at RUDEN, should, along with Mr. Foudy, be seriously sanctioned and this matter, plus Kahn’s allegations submitted to their local Bar Associations.

c) Finally, those great Wachovia’s lawyers somehow confused the very busy Magistrate Judge’s clerk into thinking… A Magistrate Judge can reverse a District Court Judge’s orders… like the Private reversing the General’s orders.

Wachovia Relies Upon Inapposite Cases that Prove Kahn’s Case and Renders Wachovia’s “Motion to Quash” Frivolous and merely a Delaying Ploy

As anyone following the only legal challenge to HD/TV/Radio knows that the major banks that were misled into funding iBiquity and its investors: Clear Channel, CBS, ABC… All 15 major radio groups and TI and Lucent/Bell Labs and more importantly, the investment banks, led by  J.P Morgan Chase, who failed to do “Due Diligence”…. Can you imagine "investing" Billions of Dollars on a putative invention never demonstrated to pass basic FCC tests and in the face of repeated analysis that proves its FULL Digitized IBOC System can NEVER work over-the-air... Bigger exposure than Chase's sub prime real estate. 

 Anyway, let's get back today to Wachovia’s lawyers LaLa Land request that the Florida U.S. District Court, Honorable Judge Gold, protect them from Loveable Leonard. They cite three cases, all of which Insult the Court because they prove Leonard's case and the Wall Street lawyers must think Judge Gold doesn't know basic law and doesn't read motions before signing ORDERS... most insulting.

Now even though you are a broadcaster and probably not an attorney, I am certain that being of sound mind, you will understand what the citations teach.

Wachovia cited a very recent decision (March 30, 2009) and it has the advantage that the Judge is fully aware of the other two cases that Wachovia relies upon... The Judge is Stephen C. Robinson... if I only I had been lucky to have assigned to any of my recent SDNY cases... Anyway the case # is 07 Civ.1978 and the Plaintiff Is a little guy like me but at least he has a lawyer that apparently his union paid for.. The Plaintiff is Maurice Thomas and he is suing big guys and even one Broadcaster, NBC, and also NYC... like me and Atlantic Express Corp., which is a bus company. First of all the Plaintiff, unlike   Leonard knew what the Judge looked, had a number of hearings...Not like Star   Chamber Buchwald, who never let me see her face, kept me out of her   courtroom, must have been a relative or maybe an old girl friend of my brother   who had lots of girl friends when he was a star athlete in high school even   more when he got out of the Army... Anyway, the Plaintiff bus driver had discovery and was not denied, like I was, an opportunity to get the goods on   RICO character Wachovia.

Now let us see what a real good SDNY Judge said about the Supreme Court Twombly case, 550 U.S. 544 (2007)…To defeat a Motion to Dismiss the Plaintiff must only allege "enough facts to state a claim to relief that is plausible on its face."

Now lets apply that to my iBiquity case...I alleged that AM & their FM owned stations WOR, WABC, WCBS, WADO, (now WBBR) & even old friend WQXR all refused to even buy a Symmetra-peakTM Kahn product... So the Twombly "plausible" requirement is clearly met. And then all that technical proof may have sailed over Wachovia's lawyers understanding... But they as the mover of the Motion to Dismiss have the "burden" to prove we are wrong. The basic requirement is as I, Loveable Leonard kept quoting to the SDNY judges:

"Motion/or Judgment on the Pleadings... For purposes of a Rule 12(c) motion, all controverted allegations in the pleadings of the moving party are treated as false, while all properly pleaded material facts in the opposing party's pleadings arc treated as true," 

Doesn't that make sense?  If a Judge is to be permitted to throw you out of Court and deny you YOUR BASIC RIGHT...TRIAL BY A JURY OF YOUR PEERS the Defendant must really have proof, Real Proof not fancy talk or clerks with influence. That brings up a point about the Second Circuit.. I think the Judges of that major court were tricked by a few "Bad Apple" CLERKS who violated the judges trust.. But in any case, Judge Gold, far away from Bloomberg, and NYU, will get me discovery under FRCP 34 & 37 on John Doe Defendant Wachovia.

THE THIRD WACHOVIA CITATION IS SO WEIRD THAT I WANT TO SAVE IT FOR THE NEXT WRATH LESSON. I ALWAYS LIKE A LITTLE HUMOR AND THIS IS A GOOD ONE… DID YOU HEAR THE ONE WHERE THEY EQUATE A CIIZEN WHO WAS A U.S. ARMY VET AND THE WALL STREET LAWYERS CITED THESE MUSLIM TERRORISTS CAUGHT DOING WHAT TERRORISTS DO AND THEN SAYING THE TERROR NUT WAS ENTITLED TO A JURY TRIAL?

Looks like the end is near for FM as we know it

Regarding “iBiquity Digital urges FCC to immediately allow FM power increase”, I note RBR has stepped up about 3 notches in information and reporting during the recent world economic slowdown. However the main pages neglect to address the truth about digital transmissions from both radio and TV. But I also notice that relatively few of our readers and friends will click on the link to check out comments by broadcasters commenting on this industry especially articles that complain about the modern switch to digital broadcasting. This sleeping sickness has taken a huge toll over this industry with respect to total package from technical to sales and operations. So this makes it possible for lying and deception to easily take control at the top and deliver rather quickly on misinformation that pulls at the purse-strings of this industry for more investments that are cutting staffing and management personnel. 

Enter digital radio and the last 10 years of marketing brilliance aimed not only at the broadcast industry, but at the auto radio makers via the support of the CEA  introducing this digital era, giving broadcasters the chance to maintain control of the expanded marketing of digital devices.  Recently the NAB released their "blessed" report from 3 tech guys wearing fresh bed-sores from the digital quarters claiming the 10db boost has not caused much problem thus far with the stations they've observed. Now our friends at NPR allegedly have released a modified study switching from the original claim that more digital power might be a bad deal to maybe it will work after all. 

Here's the truth that has been avoided during this entire digital era that has not, nor will be discussed by any of the "sold out" digital guys forced to hide under the coattails of their regional and national technical directors winning the awards for their promotion of digital radio in the USA: 

Digital modulation on FM and AM increases the interference to adjacent stations. Listening does not magically go away at the 1 millivolt level and common sensed people understand we once had "guard bands" that allowed skewing of the coverage areas and protection during "bad air" days. And jamming gets worse the more power output of digital carriers are increased. During atmospheric interference conditions the interference is unavoidable and at least 3 times the current analog interference level. And nothing will repair the laws of mother nature regardless of the hired hands writing as if their lives depended on it. None of the research justifying digital radio has addressed this massive interference during "ducting" or atmospheric conditions unfavorable to normal coverage contour predictions. The skilled techs will also raise questions about intermodulation distortion and receiver induced distortion that digital is known to enhance by multiple numbers on both AM and FM thus far totally ignored although still required in new analog FM and AM station applications. So when does this featured jamming problem show the ugly head? 

The FM and AM band receivers are now filled with noise floors beyond anything imaginable because of the current level of digital broadcasting and the future will become even darker as stations are next forced to go digital by government mandate, even if the contours fall short or become unusable during bad weather conditions. Fortunately the general public is still somewhat unaware as to the cause of these noisy conditions and simply turn off the radio or select a less noisy entertainment medium. Problem number 3: the chipsets being installed in the car radios will not go away even after digital is shut down for lack of interest. Thus analog coverage and quality will have difficult times recovering the longer broadcasters keep quiet. I encourage those with ears to hear not to quit observing and speaking out where possible to perhaps bring a few believers to the table awake, not sleeping. 

A growing number of mostly retiring broadcast technical men and women are speaking out as they exit into the next job or retirement status. To those who know the truth and refuse to speak it, heaven help you. You leave nothing for the wolves to devour but a decaying corpse whose gender is indeterminable were it to matter. The view will not be pretty. Where the animal falls could be so close to home the observers will have little doubt the attackers came from within.

In closing, a compliment to digital equipment dealers and manufacturers: You now have AM and FM sounding exactly as satellite radio does almost to the amount of technical failures the atmosphere can create. FM digital has audio quality to about 7 kilohertz quality or about half what it once was 20 years ago.  

And FM digital does sound about as bad as Compact Discs played at room levels without the benefit listening on the radio provided with good audio level control and maximum modulation limits preventing speaker damage. So your claim to the approaching quality of digital is somewhat true sad as it really is to anyone compelled to sample the decent analog signals to your new "we all sound the same don't we" concept. Radio drew a crowd because we could make music listening simple and not constantly changing between each music source. Perhaps you just forget that benefit in your efforts to expand the number of channels. Now where are the folks in hiding during this effort to take down real radio?

The owners of HD/TV, full digitized TV have honest engineers and managers, and if you ask them why the clicking on the Phone and why the Fax dies during storms they tell you the truth, it is normal with Digital Signals. BUT Clear Channel and their "InoutHouse Engineers" better not even try to tell the TRUTH, if they do there goes their jobs... In the mean time they suckered, hoodwinked, huge banks into financing iBiquity technology that has never passed, nor can it pass FCC tests, to the tune of hundreds of Billions of Dollars... And they have used hundreds of Millions of Dollars to "convince" the FCC Commissioners (See WSJ photo of former FCC Chairman "in bed" with 2 lobbyists), in a scheme to force Americans to replace their 800 Million radios... A ridiculous "pot of gold" plan that J.P. Morgan, Chase, and a group of major investment banks bankrolled, after putative "due diligence." By the way, I filed such a statement and affirmed it to Federal Judges, under the penalty of perjury, and Army field rations were bad enough, think of the food in jail ...with my own terrine, but not for foie gras and the guards never get the temperature of the Asti Spumante right, 46 degrees. No thanks...

 That DIGITAL Signals take less spectrum, If one of my students fell for that HOAX, I would make certain he was dropped, was kicked out of engineering, If your non-engineering boss is swallowing the HOAX, find a WOR in your town and let him listen to a car radio, or even better, a Digital 1 kHz fine tune radio, Draw a spectrum display, he will enjoy explaining it to other broadcasters proving he knows science. Then teach him sunspots and global warming.

 Anyway, THAT Spectrum Hoax is the real reason Congress loves the word "DIGITAL". They get something for nothing, more Spectrum to Auction Off and get more money to give to the Banking Buddies... My name is Leonard R. Kahn, and unless you are an engineer who likes arcane math and physics, or you are a patent agent or a Federal Judge, the chances are a million to one you have never heard of me...

So let me tell you why so many people who do know me, hate my guts.

BUT first let me do some bragging... I am the one (only) guy that can save Americans from another, and much more dangerous, repeat of the 9/11/01 Communications Internet OVERLOAD Disaster, Let me explain why I am in this strange situation. Legal experts will all agree that, Courts cannot provide "advisory opinions... Not even the U.S. Supreme Court can consider a case If It is not "ripe". Fortunately, my case requesting a Writ of Mandamus is ripe so that the brilliant Justice Clarence Thomas can hear my case which sounded like a simple Sherman Antitrust Boycott case In the Court of Appeals for the Second Circuit In NYC, but since I was able to offer proof that the Defendants were endangering National Security and, indeed, were joining with others to support a serious RICO charge against them and an international cabal led by J.P.Morgan Chase, (who failed to do due diligence")... I am able to allege that they were more interested in a $Trillion old fashioned treasure hunt that makes sub-prime bank frauds look trivial.., and the fiasco in HDTV caused the Washington Post, no friend of mine as I am to the right of Attila the Hun, to warn the FCC: "Do not even think about suggesting a. mandatory digital update for radio." 

If you need more proof that I know some engineering... I worked with the legendary Jack Goeken on his Airphone, the only system that worked on 9/11/01 and I lectured engineers and Governments in Europe and Japan, and I was the first to publish mathematical & experimental proof that the Ratio Square Diversity, now used by NASA to send robots into deep space and explore the edges of the universe, was Able to improve the S/N Ratio...

As to my ability to argue the law, my dispute with the Patent Office was the source for Justice Scalias famous Illogical Gobbledygook remark poking fun at the Patent Office.

AND I was so hated by the FCC Commissioners that I had my own paragraph in the FCC Act of 1934, 2007 Amendment because I opposed the FCCs digitalization of AM & FM Radio because it will obsolete, (destroy), Americans radios which they MUST HAVE to save them from another 9/l 1/01 Internet OVERLOAD Disaster,. I especially earned the ire of the Wall Street Journal that actually created the twin Monsters HDTV/Radio by printing engineering Gobbledygook such as the "Congress decided four years ago the US should switch to digital TV so some TV airwaves could be used far other things. Digital signals take just a fraction of the space of older analog TV signals." whereas Digital takes much, much, much more spectrum.

Clearly, the Congress relied on the research of the WSJ because there is no other reason for forcing Americans to spend money In these times to buy "PAY" TV & "PAY" Radio. Surely, since radio signals have lower noise than in the studios they were recorded in, it makes no sense to increase radios S/N Ratio.., and the most Inexperienced engineer can tell Hollywood  "experts" how to change the aspect ratio of TV signals..

 Let me add a few more big guys to JP Morgan, Wachovia, SunTrust, Oppenheimer Co, inc the largest investment house in the world, Clear Channel, Texas Instruments, NYC, ATT&T, etc.  A rather impressive enemy list for a little old former adjunct (Full) Professor to earn their hatred.

CAM-D inventor Kahn files suit against international banks

Kahn Communications CEO Leonard Kahn (CAM-D AM digital system inventor) has filed an amended complaint with the Southern District of NY Court (Civil Action 08-CV-11368), charging major investment banks and The City of New York and Mayor Bloomberg, personally. He names Oppenheimer & Co. specifically for falsely swearing that he was "senile" because he issued three $10,000 checks and two of them bounced. Kahn says the checks shouldn't have bounced because he has documents (attached in the suit) that prove that he had over $350K in just one account. So in the case, Kahn is also suing Wachovia, SunTrust and TD Ameritrade for allegedly "converting" his fortune (he tells RBR that just last year he claimed $18 million in assets). 

Kahn says Oppenheimer actually filed a complaint with Florida's agency for protecting the elderly that he be committed. And now the NYC Department of Social Services is trying to "interview" him based on that claim. Kahn's suit also asks for emergency relief to hold NYC from extending their "chase" to his Long Island lab which has halted his work on a solution for Homeland Security the "iSAFE" system.

iSAFE uses the CAM-D system to alert citizens in an emergency. A small receiver chip would be incorporated into cell phones, Blackberrys, iPhones, iPods, laptops, etc. that would warn of an emergency to citizens that might otherwise be unable to get to a TV or radio - or might not even hear what is going on because they're "isolated" by headphones, etc. The goal is to bring emergency alerts when the cell phone networks are overloaded and the Internet may be too congested to work (also from a potential cyber-attack). Kahn says CAM-D is robust enough to penetrate buildings, parking garages, etc. 

Kahn's suit contains 10 document attachments that he says prove that he knows what he's talking about -- including statements from Homeland Security employees, the state of Florida, FCC attorneys, etc., that attest to his life-long engineering accomplishments/patents. Actually, the State of Florida has shown in a two-page exhibit, "No Services Recommended" and issued what reads like an apology. But even though the City of NY based its action on Oppenheimer's initial complaint to Florida, it still refuses to call off their chase of Kahn. 

RBR/TVBR observation: The attachments to the suit are pretty compelling. Also, remember, Kahn filed a lawsuit in federal court in New York in 2006 alleging that iBiquity Digital, Lucent, and Clear Channel violated antitrust laws. Kahn said in the complaint that they had formed a broadcast cartel seeking to block others from buying his CAM-D system. That suit is currently being requested to be on the Supreme Court Docket.

Well, this time its not an anomaly or a digital exciter glitch at least not that we can see. For weeks now the Washington, DC market has been turning off its HD Radio signals en masse. There is no longer any station in the market on AM broadcasting in HD. ESPN Deportes Radio/Red Zebras 730 WXTR-AM long ago shut off the signal. But now that list includes 630 WMAL (Citadel); 570 WTNT (Clear Channel); Red Zebras 980 ESPN Radio; and 1500 WFED-AM (Bonneville). The FM list now includes 106.7 WJFK-FM (CBS Radio); 102.3 WWMJ-FM (Radio One); 104.1 WPRS-FM (Radio One) and 107.7 WWWT-FM (Bonneville).

RBR/TVBR observation: The most likely culprit is licensing fees. Just not worth it for some in tough economic times. Also, these FMs did not have HD multicast (HD2) signals, and two of them were broadcasting in mono so what's the point? For the AM side, unless you are 50,000 watts, most radios can't pick up AM HD very far from the tower array. WFED is 50-kW, but you'd never know it because of its higher frequency just doesn't propagate well." 

What did Radio World, Inside Radio, and the Wall Street Journal say about the iBiquity multi billion failure, nothing, nada, zippo just like they have said nothing about the Kahn vs iBiquity, Clear Channel, TI, Bell Labs law suit that appears to be won. Only Radio Business Report- the voice of broadcasting broke the silence.

Subject: A Free Market Rescue Plan 

Dear Letters to the Editor, Editor:
Now that we are reaping the results of a politically induced Wall Street PANIC, I believe a free market plan can save all major firms providing credit to growth businesses, is a worlds leading source of investment credit. Obviously, the Government has not been able to cure the PANIC or even mitigate it. 

Thus it is the purpose of this Letter to suggest the following free market solution that will not cost the Government or the banks and, most importantly, the Public a penny. A Real FREE market solution. Succinctly, in just 16 words, the proposed solution would require:

The bank, the seller and the buyer, to all live up to their original Mortgage Agreement. 

The solution is not only simple, it is well founded in Federal Law, i.e., qui tam. See 31 U.S.C. 3730.

Indeed, the requirement for the U.S. Government to pay its debts, goes back to George Washington prior to his becoming our first President, when be personally paid the payroll of the Army he commanded. At the end of the war he successfully made a demand that the Congress pay him for all of his expenses in supporting the Army. This same qui tam Concept was used after the Civil War by former slaveholders who were paid for General Shermans troops "borrowing of their horses, etc."  

Now, since the FDIC FORCES all insured banks to use ASA appraisers, the Government is responsible for the many mistakes made by appraisers. Therefore, it was the Government that created the problem of all FDIC insured mortgages for both poor and wealthy homeowner mortgages to be "protected" by the U.S. government. Thus, the Government and ultimately, we taxpayers, by electing the Congress that created the problem, must compensate individuals that mortgaged properties (especially in 2006-2008) and now suffered severe financial damage to their homes. Thus, the instant proposal conforms to FREE MARKET concepts. 

The situation is analogous to the Government borrowing $106,900.00 from individuals, i.e., U.S. Bonds (Fixed Rate 30 year "Uncallable " Bonds) and then, after 3 years, Uncle Sam drops the rate. The only difference is that FDIC banks are loaning money to homeowners, and these homeowners would never guess they were being subject to might in this alphabet era as a Full Faith Fraud (FFF) between a quick buck alliance between the Congress, Banks, Real Estate Salesmen, & The American Society of Appraisers. 

Another "professional" group that has caused Individuals caught by the sub-prime trap additional harm are rating firms that immediately change (reduce) ratings without any examination of the facts. Legalized commercial defamation libel. 

Additional Exasperating Factors
Another factor that has exasperated the problem is the huge bureaucracy that banks have become housed in golden temples wasting significant amounts of money. Such waste of money clearly impacts on the amount of money that could (should) be used to attract better and more innovative mid-­management personnel. 

ADDITIONAL STEPS TO HELP CURE DETROIT'S PROBLEM
Once the proposed solution cures the mortgage problem and the public is no longer poor, families are going to engage in one their favorite activities, shopping for new cars. And of course, even if Detroit cars are not as good as foreign name ears, Americans will still favor American cars and allowthem to compete. 

A KEY "FREE MARKET" SOLUTION FOR DETROIT
Having dealt with the big three in the 1980s during the AM Stereo competition with Motorola, Harris, Magnavox and RCA where our system had the main stations including WNBC, WOW WABC, WHN and the high fidelity classical music station WQXR, the undersigned was, of course, then, and now, aware of the huge union problem... But there is a far more serious Detroit problem. 

American car manufacturers have a deal that protects them from competition.  This is one of a few unfortunate bequests from Henry Ford, who would never deal with Wall Street and with automotive inventors. Ford is hailed by the public as a great inventor, (as is Bill Gates), but the only real invention he made is his interchangeability of parts, an obvious concept that any routine mass production engineer instinctively knows, and would have known when Mr. Ford offered the public: "Any color as long it was black." 

In any case, the situation is that GM, Ford & Chrysler have since automobiles first became a major industry agreed to not to exclude each other for more than 2 years from the first introduction of any patentable innovative step instead of 17 years from issuance, (now normally 20 years from applications date.)  

(Therefore, instead of licensing my invention at fair license of 6% of the net price and providing full assistance to GMs engineers who, in all honesty, were unskilled in the arcane field of radio modulation, so we were left with  licensing  foreign firms including Sony and other Japanese firms, to make good performing AM Stereo car radios.) 

Obviously, such a corporate attitude, not only may violate Sherman antitrust laws and U.S. trade treaties, but it has helped act as a major reason that foreign based car firms to be far more innovative than Detroit manufacturers.  

Thus, more than the super expensive deal Detroit made with its Unions, it drove American inventors to license foreign firms as we did Sony and Sansui. This violation of basic antitrust law can be readily rectified by the Congress and/or the Justice Department.

And, therefore, I can set the royalty at 6% which is a fair royalty that we can make a huge fortune.., every year... for an unlimited period as we will end up relying on trade secret and trademark law...not patents unless the courts suddenly get free of its anti patent bias. The only way I can be stopped is if Uncle Sam becomes Uncle Soviet and then gets three more Uncle Stevens on the Court.

 Bottom line.,, Who do you think I and every single HONEST.., bank, small & large honest businessperson, and little guy all over this Greatest Country in the World, ever, who should be thankful for the Greatest President in the last hundred years, President Bush whose record cannot, in less than 30 days be surpassed, in keeping America SAFE, will vote for?

This is the most serious, ever, issue of the Wrath, because American LIVES are at stake, indeed lives all over the world are in danger... and any attempt at humor is obviously inappropriate.

Some months ago, I woke up from a nasty dream wherein I was having an argument with this guy who demanded I apologize for hinting in filings in a Federal Court that Lucent's Bell Labs was no longer a top notch research lab, certainly not competitive with the Bell Labs I knew thirty years ago when I was consultant to them on modulation theory.... Anyway the argument ended up with a challenge (question)... Is it impossible to solve the Internet OVERLOAD problem that caused the loss of all those human beings on September 11, 2001?

I then woke up and realized that my nightmare had raised the wrong question. Yes, it is impossible to cure the Internet problem as Bell Labs and Texas Instruments think, the math & physics prove they are wrong...

But that is the WRONG PROBLEM Bell & TI are working on. The RIGHT PROBLEM is ACOUSTICAL ISOLATION.

Let me offer an example... You are on a busy highway and the driver ahead of you is listening to HIS MUSIC, not your AM or FM station. He is listening to his own CD... How do you know? Because you can hear his 500 Watt audio amp, and you can see his car vibrating at the beat of the music!!!

Now there is an accident about a mile ahead and you see the brake lights of the cars ahead.

So you BLOW YOUR HORN, but the guy listening to his music is in his ACOUSTICAL COCOON and therefore he may not even hear Gabriel blowing his horn.

That is one example of the REAL PROBLEM that endangers every single American, man, woman and especially every child (who thinks the "acoustical cocoon" is part of being human) ... and is the real reason for the Virginia Tech Massacre and the failure of all 911 service in California where you are instructed by the police NOT to use 911 and take an accident victim to the nearest hospital in your own car... No ambulance service anywhere in California.

What is iSAFE?

It is a new series of Patent Applications, Patents, and Trade Secrets that enlist AM & FM stations in all 50 states and, indeed in Puerto Rico, Guam, everywhere the Flag protects Americans, to alert Americans of dangerous life-threatening situations.

Then who will? Anyone who buys a cell phone, iPOD, iPhone, a car radio... or any new iTOY will pay a very reasonable royalty of a one time 6%... less than half of what the FCC declared was reasonable to iBIQUITY for a perpetual license. 

But I don't have to figure in the cost of lobbyists to buy FCCers lunch... 

Now what does this amount to, a $200 iPOD would cost $212 to use the iSAFE trademark. Would you pay $12 to save the life of your child? 

Indeed, since warnings are localized wouldn't you pay $12 to be told to wait an hour before you go on the parkway, it is bumper to bumper right now? We can sell iSAFE, because it is really worth the money... 

And why shouldn't we, including all former loyal KCI employees get some real money and also the Reading Machine for the Blind, needs big money for R&D and advertising which Ruth wanted funded to the very end... And there are all sorts of other medical problems that must be solved by use of EFFICIENT R&D, not Bell Labs and Uncle Sam's way of 20 year projects for some sterile technique.  

Anyway, KCI will make good use of its money... 

That 6% of every single cell phone, iPOD, car radio, etc., etc., in my honest opinion will be THE LARGEST MONEY MAKING PATENT EVER FILED FOR IN THE UNITED STATES, OR ANY OTHER PATENT OFFICE...  

Yet it will not require one bit of support from any government agency as we never took, or will take, a penny of government support that is required for us to do the necessary further developments to make us safe in these dangerous, life-threatening, times. 

NOW IS THE TIME FOR ALL GOOD BROADCASTERS TO REALLY COME TO THE AID OF THEIR COUNTRY... 

So even if you are being scared by politicians into a depression to win an election, do not worry, the day after the election they will admit they were wrong and the gas and housing problem will be solved, the same way, getting government bureaucrats out of the way of business people.

HAPPY NEW YEAR 

But what a challenging year... 2007 started with only a handful of true friends, including the best group of KCI veterans and a few really, really loyal true Cam-DTM engineering believers and almost no one believed that a complex legal case that was already thrown out of the NY Federal District Court could ever get the Court of Appeals in NY to spend real time on it as it was so overloaded with 9/11/01 cases and Guantanamo Bay and all that corruption on Wall Street... But then just in November the FCC lawyers and engineering "buerats" ... I always have trouble spelling that word... Really, really stuck their foot in it... And accepted my challenge and forced iBOC AM stations to go on at night... 

And then the rational iBOC stations, led by ABC turned the darn thing off... Even NPR stations that are paid not only to install iBOC but are paid to promote, "propagandize" it, turned it off... This includes the mighty bunch of NYC stations... WABC, WCBS, WNYC, WADO (biggest Spanish and a former KCI PS station) and WFAN... BUT not the biggest butt in NYC, WOR thanks to its engineer, who always is so helpful.... now reminding people all over the East Coast just how bad iBOC +/- 30 kHz from 710 kHz is and how it decimates WOR's own reception, even in nearby Hartford. 

And then came the wonderful turn around in the Courts... Notice how quiet RW and even M Street is and how about that WSJ... That great defender of the First Amendment... Free press that somehow always protects the big lobbyists... NOT A WORD about the major Court action not a word about the engineering iBOC Disaster... So how come KCI enjoyed the slow but sure advance of Cam-D... Well just a handful of smart guys who knew over double their coverage would at least double the value of their stations. Sure enough Cam-D grew greatly in '07... 

Unfortunately, probably the smartest such broadcast operator, Mr. Otto Miller died, at just 59 years old. Otto kept buying stations with highly leveraged money all over the USA... each time in a larger market... The only thing wrong with Otto was he was most intense in his negotiations... made me sound like I was gentle... And two weeks after I warned him that he was getting worse and he promised he would calm down, Otto dropped dead during a very nasty conversation with a lady who loved him... Otto was a good looker... and didn't realize ladies didn't mean to hurt him. That last conversation I had was to finalize the Cam-D deal and No he could not get "at least some discount" for a new Cam-D Box... a doggy station that would now cover Mew York City, even at night... Anyway, we expect to finally get into the Big Apple in '08... So those ad agencies will hear how great Ancient Modulation can really sound like.

Cam-D isn't always reliable. A Confession
 Let me share with you a FAX but all names, etc. are deleted to protect the Innocent...  

"HI Engineer Friend: Re our FAXes and phone conversations, I would like to make a proposition... But first let me state what I believed happened... First of all, I understand that the Cam-D unit gave you a dramatic improvement... and I remember the Boss (station owner) saying it doubled the value of his station... and now you are louder than the 50 kwatter, even at night and even though the big guy has a much better frequency. 

But, recently you heard severe noise, so bad the PR ordered you to yank Cam-D off the air... And then the irate listeners called saying; You killed our station... Fix It immediately!!! So you ran out to the Xmtr shack and everything looked & sounded OK, but Just when you were leaving you heard a noise, not from the Monitor but from the Cam-D Box... And then you found the problem. 

And you saw those two beady eyes staring at you when you tried to check the cables going into the Cam-D Box... a MOUSE.., KCI is not equipped to handle such problems... being city folks...

Accordingly, KCI Is returning your unit unopened. You must dispose of it. This is a very serious matter as the unit has a meter on it and power supplies and all stuff that any 12 year old kid ham would die for... It is what lawyers call an attractive nuisance and therefore you must get someone authorized to dispose of it... IMPORTANT. 

 But in any case, I will not permit my employee/friends to work on equipment if it was so exposed.. So we are sending it back... We will take the loss, but only for this one time. I assume you are insured for such problems, but you cannot return the unit so that the insurer can salvage it, as Cam-D is protected by Trade Secret Law, and as I told you in my opinion, the new Federal Law makes it a felony crime to violate Trade Secret Law and I believe your attorney will tell you Microsoft used all its political power to make it a really, really tough law.  

Great News for Stations Never "Moused" 

Now let me tell you the good news... For $4,050 you can buy a mouse resistant, water resistant, lightning resistant, and theft resistant transmitter building... And since we will never fix "moused" Cam-D Boxes, if you folks want to continue to, at least double your coverage spend the $4050... Maybe less if the supplier in your town overstocked these steel shipping containers (20 x 8' x 9' 6) with big doors and sealed power and audio inputs and an antenna output), the price can be lower. And then your station is safer for the transmitter and for you if you use a good lock on the building and  you have a sensor that allows you to catch copper crooks mining your ground system. Is this a KCI innovation? NO. Tim Cutforth has been doing similar stunts for years and a great Lady GM... Non-Engineer asked me years ago why it wouldn't work and I fell in love with her beautiful brain and they said she was a beauty even though I never met her. 

Get Ready FCC... Leonard is Coming Back
Even though we cannot share the R&D Engineering credit we are getting the legal credit, as we are filing a Rule Making requiring all AM & FM and TV & Satellite stations to spend a few thousand dollars to protect the Public Interest in the Rodent With Sharp Teeth War (RWSTW) and lightning, etc. as a price for being even a part time unattended station... and also have toilet facilities because engineers should be at least taken  care of as well as mice and also since all Xmtrs are more reliable when the temperature is regulated... I know this sounds like I have joined the Liberal Party, but we think it is only good business to provide a healthy and comfortable workplace at KCI. So that is my Petition for Rulemaking... And I expect Wrath Engineers and most importantly, Owners, to support it if the FCC Issues a Docket Number.. That's an insider legal joke... the biggest FCC joke, ever... since 1934.

Anyway HAPPY NEW YEAR.

I read with great interest all your many comments about the moderate to severe interference from the night time ops of various IBOCdigital AM stations, now approved, (with conditions), by the FCC. 

For me it is a sad day, (and night), as I hear much ofthe same noises and severe "buzz saws"

here in South Florida that youare experiencing in theNorth end Midwest part of the country, 

Day or night I have been very disappointed with the iBiquity AM digital signals here locally as well. First and foremost, is of course, the severe adjacent and co-channel interference issue. However, in addition to that, the general audio quality of the two local Miamistations running the current, "popular"System well, just stinks! To say this audio is "as good as current FM," is wishful thinking at best. I maintain five FM stations here in South Florida and critique My own, and several others here in the Miami area, and I can tell you our analog FMs sound far superior to the local digital AMs, I Was even in Chicago recently and my old home favorite, WGN, sounded just as poor in digital as my local Miami stations. 

Plus, when driving, even in the main coverage area through the Miami area, the signals fade out and in, often. When driving near, or under power lines and bridges, the digital AM signal fades back and forth between analog and digital so much, it seems pointless to promote that these systems will hold up under any kind of signal degradation from man-made terrain effects! The radios just switch back to analog, and you experience the same problems of man-made terrestrial interference we always have with AM radio. 

I have found the solution for AM radio. I wish more of us could get on the bandwagon. I have installed two, and assisted with the installation of a third, Kahn CAM-D digital AM system in the past year, and I must say, it Works!! The CAM-D systems perform fantastic. First, theCAM-D provides a "REDUCTION" in the adjacent and co-channel interference over Current transmission system, and far below that caused by the iBiquity system!  In addition, the digital AM sound is superior to the popular system, the Cam-D actually sounds like "CD quality". The, audio is clean, with no notable distortions and hash associated with theother brand of system. In addition, the Cam-D system improves the overall signal coverage of the analog signal somuch, (through a superior Modulation concept), that it is an instant benefit to the stations operating with it "today", not five years from now when, "maybe", there will be enough digital radios on the road for stations to benefit from it financially. In addition, the Cam-D system does not have the fade problems in moderate signal areas that I experience with the other IBOC system, (due, I believe, to the exceptionally good modulation scheme).

 In short, the Kahn Cam-D digital AM transmission system is far Superior to what is being "pushed on us" by big Money, and politics to boot!! 

If you get a chance to listen to a station broadcasting with the CAM-D system, give a serious critique; I believe you will agree, it is far superior to what is currently being shoved into our ears. I also suggest you check out Kahn's web site for the latest info: www.wrathofkahn.org.

THE FCC'S LATEST "FINAL" IS A JOKE ON iBOC 

In a huge document printed in the Federal Register now available on the Wrath in easy to read print (go to the latest "Previous Week" button) the long expected final, final, really, really no kidding final Rules in which the FCC played a little joke on the Trillion Dollar iBOC team, including Clear Channel, Lucent etc. who are ready to trade the safety of over-the-air radio for a piece of that Trillion Dollar pie in the sky scheme. 

Enuf talk Leonard, tell us the joke... OK, OK 

On Page 45671 the FCC states that it: "Recognizes that further negotiations between the United States and the international community are taking place to resolve possible disputes about the implementation and operation of DAB [Digital Audio Broadcasting... AM & FM radio] by domestic radio stations.." 

In other words, as the WRATH reported last week, the Mexican Government sent the State Department a very, very tough letter warning us that even our border stations were interfering with Mexican stations and stop it... It sounded like troops were marching... And since I haven't bragged yet but a long time ago I spent about a month in Geneva as the State Department's (one and only) radio expert.. they didn't want more than one because even then the USA was worried we might look like bullies, so unlike France who had like ten engineers, I had to work all the committees whether or not I knew what I talking about... Anyway, I at least convinced the Germans not to desert AM radio in favor of all FM... Leonard that is enuf. Last word the FCC has about as much chance of convincing the ITU to accept additional interference from iBOC jammers as I have of winning the Olympic pole vaulting gold medal. 

Anyway, let us get to the PUNCH LINE of the FCC's little joke on my iBOC friends. 

On Page 456871 after telling iBiquity some really, really bad news about Patents that they may not fully understand.. We finally get to the Joke re international treaties: The FCC opines that: "While we are optimistic that we will be able to resolve any outstanding issues with Canada and Mexico or other countries, these issues remain subject to ongoing negotiations. Therefore, until the negations are completed, we advise the radio industry that the following condition will be applied to stations operating with IBOC DAB: Operation with facilities specified herein is subject to modification, suspension or termination without the right to hearing...." 

Since I want to be certain RW and the Trillion Dollar international cartel including Clear Channel and Texas Instruments and Lucent gets: the JOKE, let me repeat: Therefore, until the negations are completed, we advise the radio industry that the following condition will be applied to stations operating with IBOC DAB: Operation with facilities specified herein is subject to modification, suspension or termination without the right to hearing...." 

So you broadcasters, who maybe spent a million bucks for IBOC gear, this isn't all that funny, especially when you decide to try to prove your station doesn't increase interference. Sorry, but you really have to be careful when someone sells you a device that has never worked at night, and you don't even take the time to tune into stations that real engineers tell you are jamming their neighbors.

CAM-D SERVES TWIN CITIES 

KOOI, Watertown, Minnesota could never effectively reach the twin Cities of Minneapolis-St. Paul. It has a pattern pointing straight north bypassing the cities 40 miles to its East. The 5000-watt outlet at 1600, formerly KWOM, was purchased by previous owners with the expectation they could serve the Cities. They would ask this engineer if the station could cover and, buy anyway, despite my advice. 

KOOI is now under new ownership, yet is now capable of serving the Hmong community in the twin cities. It was time to think outside the box and KAHN CAM-D was installed July 4, 2007. Our signal is six times louder, the audio quality is excellent, and I estimate coverage is three times greater outsidethe main lobe of our three-tower pattern. 

The feature I liked the best is the ability to choose the upper or lower sideband. We choose the upper to further remove ourselves from 1590 in Hudson, WI. This does not affect the ability of a receiver to center tune. All of these advantages are realized without expensive modifications or FCC approval. 

I recommend KAHN CAM-D to all stations big and small, but particularly to those with complex patterns on close adjacencies. I want to thank Leonard Kahn and Tim Cutforth of Vir James for their technical wisdom during this installation.

One of the best AM and FM Directors of Engineering in the USA has had an exchange of emails that he shared with me. Knowing the management of some of the stations that our friend serves as DE may not want other stations in their market to know the secret of their success, the Cam-DTM System, we decided to keep the venue of this WRATH "under seal," at least for a short period. (This reminds me of a station in Detroit at least a decade ago, who bought a single POWER-SideTM unit and decided that he wanted us to give him a market exclusive and when we refused, he misinformed stations by telling other stations the reason his coverage was so much better was that he was using a new audio processor...But an Engineer with a spectrum analyzer in Windsor, who was also using POWER-Side, finally got him to stop telling his "story.") 

ANYWAY, This is what happened in a very significant market that will be kept hush, hush until our friend and the WRATH gets full approval of all of the stations involved: 

"Thank you for your proposal, however, our stations have chosen to use the Kahn CAM-D digital AM transmission system, as opposed to the IBOC system. The Kahn system has greatly improved our coverage, and the CAM-D digital signal has proven to be superior to the IBOC.  

Although we consider the "deleted" brand of transmitters to be the finest in the industry, the IBOC AM digital system has proven itself to be a very poor substitute for the Kahn CAM-D, causing much interference to other stations, plus the audio quality of the IBOC is very poor, as compared to the Kahn system. We have no plans to use the IBOC system for any of our stations at this time. But thank you again for your proposal.

Mexico and the NRSC member from the U.S. Bureau of Standards just pulled

iBOCs plug ending their scheme for monopolizing AM & FM Radio

As you know the WRATH has been telling you for years that the iBOC system would never be approved BUT all the trade publications said we were Wrong... But we told you that the Telecommunications Act of 1934 requires that any firm  proposing new technology must:

a)      Not Increase Interference to other licensed stations and

b)      Not violate the antitrust laws.  

Clearly, anyone with a radio in Washington can hear all of the iBOC stations (still on the air) jamming their co and adjacent channel neighbors. As to b) antitrust, any senior employee of Clear Channel knows that he is required to boycott all Kahn products not only Cam-DTM  Exciters that at least double your coverage and make you sound like FM on all radios, but even our Ugly SymmetrapeakTM audio unit that makes your FM station 3 db louder. Anything with the Kahn name or it must be taken, off the air because we dared compete with the iBOC system and refused to join their scheme to obsolete every AM & FM radio in the USA, all BILLION radios, so as to control a $TRILLION industry. 

Anyway, Mexico proves that IBOC violates the interferencerules, but they raise a far more compelling issue... The US Constitution requires all branches of our government, the Administration, the Congress and the Judiciary to respect and not violate out treaties... So Mexico's filing makes it certain not even the Congress can rescue iBOC... And there is more... The Bureau of Standards scientist, Dr. Jonathan E. Hardis, either is a trained lawyer of he had a real expert on patents and trade secrets write the FCC document As some of you guys know I am a US Patent Agent and one of my patent briefs, In re Leonard R. Kahn was used by the Supreme Court to rewrite important Patent LawForgive me for bragging, but it is genetic... So Dr. Hardis is right on when be concludes that, not only has iBOCs chief proponent lost, he can never comeback to the FCC with a new DAB proposal... First Mexico almost declares WAR and then Dr. Hardis decapitates them with his legal scalpel. 

So why am I telling you all, this... Because KCI is going to make a run of six (6) Cam-DTM Boxes and they will be delivered on a first come first basis... Need more info,call me at 212.983.6765 and leave word when I can reach you at night when I return calls.

Specifically, we wish to let you know of the [Mexican] Federal Telecommunications Commissions concern, in light of the aforementioned notice, that this matter is among those that properly fall within the purview of the U.S.-Mexico High-Level Consultative Commission on Telecommunications (CCAN), on which both we and the FCC, of which you are chairman, are represented, among other parties. 

In this light, we call your attention to the various meetings of the CCAN Working Group including representatives of our two agencies, which have been held to deal with Radio Broadcasting issues, among others, in the course of which the FCC was reminded that U.S. radio stations that operate using the IBOC system must comply with the provisions of the Convention between the government of the United States of Mexico and the government of/he United States of America regarding AM Radio Broadcasting in the Hectometric Wave Band, signed in Mexico City on August 28, 1986, as well as with the provisions of the Agreement between the Government of the United States of Mexico and the Government of the United States of America regarding FM Radio broadcasting in the 88 to 108 MHz Wave Band, signed on August 11, 1992. 

Accordingly, until technical criteria shall have been established by agreement between our two agencies to permit optimal and efficient development of analog and digital radio broadcasting along our common border, and in order to eliminate prejudicial interference with Mexican broadcasting stations caused by the temporary operation of U.S. radio stations using the hybrid digital system, we ask you to reconsider your decisions to authorize AM radio stations to operate at night and permit FM stations to operate using the extended hybrid digital system.

 ARE CELL PHONES KILLING AM & FM RADIO?

 Have you read the latest SPIN to convince you not to worry about the HUGE negative impact of Cell Phones on the value of your AM & FM station licenses? They say 96% of college educated 35-54 people listen to radio at least once a week. Let the WRATH parse that feely good, good, not to worry GORBLEYgoodee about the impact of the Internet...I dont know what going to college has to do with radio, but 96% of anything is sure Impressive... But that once a week thing...Does that mean if you happen to be waiting at a red light and some 50% deaf and 100% dumb kid is pumping out a 1/2 kw to vibrate his hubcaps you are credited with a listener?WRATH recommends we get real and look at meaningful numbers like a listener is listening at least 1 hour per day to one  of the 5 radios the average American has access to in his home, car and portable. And if we are interested in the future do preteenagers know what a real radio looks like... three year olds sure know what a cell phone looks like... Thats the thing growing out the side of mommies head. 

THE WRATH GETS CREDIT FOR A CHANGE 

The WRATH was proud that some publications indicated we might be right that iBOC is dead by treaty... Castro and our  dear friends in Russia, Germany, the Saudis, etc. But even though you dont have to kill IBOC twice, the other stake through its heart is that it violates the Communications Act of 1934 by INCREASING INTERFERENCE, the very reason for the FCCs existence and to guard against broadcasting monopolization... To put it another way if the FCC decided to ignore the Constitution re treaties, they still are in violation of the Law.
